Special Cases

This Part describes entitlement to benefits which are not part of the contributory, occupational pension provisions of the FPS.

Rules J1 and J2 set out the terms under which Guaranteed Minimum Pensions are payable under contracting-out rules.

Rules J3, J4 and J5 set out injury provisions but they were deleted from the FPS with effect from 1 April 2006 when injury awards were moved to the Firefighters' Compensation Scheme. Rule J3 explained the discretionary powers of a Fire and Rescue Authority to make an injury award to an employee who was not a regular nor a retained firefighter. Rule J4 explained the injury award provisions for retained and volunteer firefighters. Rule J5 explained which other FPS rules applied for the interpretation of Rule J3 and J4. In case reference needs to be made to these Rules for old cases, the explanation of the three Rules is retained in this Commentary as "archived" material.

Rule J6 refers to other special cases covered by Parts IV and V of Schedule 11, i.e. those who are "1956 Optants" or covered by Local Government Reorganisation or "Combination Schemes".
